End-Payor Antitrust Settlement
The State Attorneys General from all 50 states and territories and End Payor Plaintiffs represented by private class counsel have settled (subject to final approval by the Court) a lawsuit involving the prescription drugs Remeron® and generic mirtazapine. The States and End Payor Plaintiffs alleged that pharmaceutical companies Organon USA Inc. and Akzo Nobel N.V. improperly monopolized the U.S. market for Remeron® and mirtazapine.
Under the terms of the proposed $36 million nationwide settlement, consumers are part of the Settlement Class, and may be entitled to a cash recovery for their out-of pocket expenses. Part of the Notice Plan approved by the Court includes the assistance of Physicians in identifying and notifying Settlement Class members that may have been affected by this litigation.

We want to ensure that patients who were prescribed the Mirtazapine Products learn about this settlement and the opportunity to file a claim. We are asking for your support and assistance in notifying your patients who were prescribed the drug Remeron® or generic mirtazapine from June 15, 2001 through January 25, 2005 of their potential claims. On this site you will find a Summary Notice to be printed and displayed in your office, posted on your website, or to be copied and sent to your patients. It has been our experience that direct contact is the most effective method of notification. Your assistance will help ensure that consumers are notified of their rights. We want to thank you in advance for your cooperation and assistance with this important job. If you direct your patients to our settlement website, they can download the Consumer Claim Form or file a claim online.
